These Terms of Service ("Terms") govern your access to and use of SimpleClaims' website, mobile application, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 16 years old to use the Services. By using the Services, you represent that you meet this age requirement and have the legal capacity to enter into a binding agreement.
3. Account Registration
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
- You are responsible for all activity that occurs under your account.
4. Service Plans & Billing
Free Plan (Homeowners)
The Homeowner plan is free and includes core features with limited claims capacity. We reserve the right to modify free plan features with reasonable notice.
Paid Plans (Contractor Pro & Vendor Pro)
- Paid subscriptions are billed monthly or annually, as selected at checkout.
- All fees are non-refundable except as required by applicable law or as described in our refund policy.
- We may change pricing with 30 days' advance notice. Price changes do not affect current billing periods.
- Free trials do not require a credit card. You will be notified before any charges begin.
5. Your Content
You retain ownership of all content you upload to the Services, including photos, videos, documents, and claim data ("Your Content"). By uploading content, you grant SimpleClaims a limited, non-exclusive license to store, process, and display Your Content solely to provide the Services.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or to submit fraudulent claims
- Upload content that infringes on intellectual property rights
- Attempt to gain unauthorized access to the Services or systems
- Interfere with or disrupt the Services or servers
- Use automated systems or bots to access the Services
- Reverse engineer, decompile, or disassemble any part of the Services
7. Intellectual Property
The Services, including the website, app, logos, design, and software, are owned by SimpleClaims and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Services without written permission.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SimpleClaims does not guarantee that the Services will be uninterrupted, error-free, or secure. SimpleClaims is not an insurance company and does not guarantee the outcome of any insurance claim.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SimpleClaims shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.
10. Indemnification
You agree to indemnify and hold harmless SimpleClaims, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Services or violation of these Terms.
11. Termination
You may terminate your account at any time through your account settings or by contacting us. We may terminate or suspend your account if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will provide reasonable time to export Your Content before deletion.
12. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Dallas County, Texas.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the website at least 30 days before taking effect. Continued use after changes constitutes acceptance.
